A note before you start

These Terms of Use explain the rules for using the Tihna app. We've written them in plain English so they're easy to read. Please take a moment to read them before you use the app.

By downloading, installing, or using the Tihna app, you agree to these Terms. If you don't agree, please don't use the app.

1. About Tihna

Tihna is a sound frequency wellness app made by Tihna Health, an Australian company based in Victoria. The app delivers audio experiences — including sound frequencies, tones, and soundscapes — designed to support relaxation, focus, and everyday wellbeing.

Tihna is available on iOS and is distributed through the Apple App Store. Your use of the App Store is also subject to Apple's own terms.

These Terms form a binding agreement between you and Tihna Health (referred to in these Terms as "we", "us", or "Tihna").

2. Who can use Tihna

You may use Tihna if you are:

  • At least 13 years old; and
  • Able to form a legally binding agreement.

If you are between 13 and 18 years old, you should review these Terms with a parent or guardian before using the app.

Tihna is intended for personal, non-commercial use.

3. Wellness tool — not a medical device

Tihna is a wellness and relaxation app. It is not a medical device.

The sounds and audio frequencies in Tihna are intended for general wellbeing purposes only. They are not intended to diagnose, treat, cure, prevent, or alleviate any disease, medical condition, or mental health condition.

Nothing in the Tihna app — including its content, audio frequencies, or any information provided — is a substitute for professional medical advice, diagnosis, or treatment.

Always consult a qualified healthcare professional before making any decisions about your health, including decisions about changing or stopping any medical treatment. If you are experiencing a medical or mental health emergency, contact emergency services (000 in Australia) or a qualified health professional immediately.

Using Tihna does not create a healthcare or therapeutic relationship between you and Tihna Health.

4. Safety warnings

Please read the following warnings carefully before using Tihna.

Epilepsy and seizure conditions

If you have epilepsy, a seizure disorder, or any condition that makes you sensitive to sound, light, or rhythmic stimulation, do not use Tihna without first consulting your doctor. Some audio frequencies — including binaural beats and rhythmic tones — may affect people with these conditions.

Hearing conditions

If you have a hearing condition, tinnitus, or any sensitivity to sound, consult your healthcare professional before using Tihna. Always use headphones and audio equipment at a safe and comfortable volume. Do not use the app at high volumes for extended periods.

Driving and operating machinery

Do not use Tihna while driving, operating machinery, cycling, or doing anything else that requires your full attention. Some content is specifically designed to promote deep relaxation or a drowsy state and is not appropriate to use in situations requiring alertness.

Pregnancy

If you are pregnant, consult your healthcare professional before using Tihna, particularly if you intend to use headphones at length.

Children

Tihna is not specifically designed for use by children under 13. If a child uses the app, a parent or guardian should supervise and review these safety warnings with them.

5. Your account

To access certain features of Tihna, you will need to create an account. When you create an account, you agree to:

  • Provide accurate and up-to-date information
  • Keep your login credentials secure and confidential
  • Tell us promptly if you suspect your account has been accessed without your authorisation (contact us at brainfrequency@tihna.com.au)
  • Take responsibility for any activity that occurs under your account

Your account is personal to you. You may not transfer or share your account with another person.

6. Subscriptions and pricing

Tihna offers the following access tiers:

All prices are in Australian dollars and inclusive of applicable taxes.

Free tier

The Free tier gives you access to a limited selection of Tihna content at no charge. A paid subscription unlocks the full Tihna library.

Monthly and Annual subscriptions

Monthly and Annual subscriptions are auto-renewing. This means that unless you cancel before the end of your current billing period, your subscription will automatically renew for another period and your payment method will be charged.

For the Annual plan, you will be charged AUD $59.99 at the start of each annual period. This is approximately AUD $5.00 per month — a saving compared to the Monthly plan.

Lifetime access

The Lifetime plan is a one-time purchase that gives you ongoing access to Tihna content without any further subscription charges. "Lifetime" means for as long as Tihna Health continues to operate and offer the app (see Section 13 regarding changes).

Payment processing

All payments are processed through Apple (via in-app purchase). Apple's payment terms and billing policies also apply to your purchase. You can manage your payment method through your Apple ID settings.

Billing confirmation

When you subscribe, you authorise us (via Apple) to charge the applicable fee to your payment method. You will receive a receipt from Apple for each charge.

7. Free trial

The Annual plan includes a 7-day free trial for new subscribers.

Here is how the free trial works:

  • The trial gives you full access to Tihna for 7 days at no charge.
  • You will not be charged during the trial period.
  • At the end of the 7-day trial, your subscription automatically converts to a paid Annual subscription and your payment method will be charged AUD $59.99, unless you cancel before the trial ends.
  • To avoid being charged, you must cancel before the trial period ends. See Section 8 for how to cancel.
  • If you have previously had a free trial for the Annual plan, you are not eligible for another free trial.
  • Free trials are not available for the Monthly or Lifetime plans.

The trial period is managed through Apple's in-app purchase system. The exact trial start and end time is confirmed in your Apple subscription settings.

8. Cancellation

You can cancel your subscription at any time.

To cancel, go to your device's Settings → [Your Name] → Subscriptions → Tihna, then select "Cancel Subscription". You can also manage your subscription through the App Store.

When you cancel:

  • Your subscription will not renew at the end of the current billing period.
  • You will retain access to paid features until the end of the period you have already paid for. For example, if you cancel a Monthly subscription on day 15 of a 30-day billing period, you keep access until day 30.
  • Once the period ends, your account reverts to the Free tier.

Cancellation does not automatically delete your account. To delete your account, see Section 14.

9. Refunds and your consumer rights

Your Australian Consumer Law rights

As an Australian consumer, you have automatic rights under the Australian Consumer Law (ACL) that apply to your subscription. We cannot exclude, restrict, or modify these rights. They exist regardless of what any other part of these Terms says.

Under the ACL, if the Tihna service:

  • Is not delivered with due care and skill;
  • Is not fit for the purpose we described or that you told us you needed it for; or
  • Is not available as represented —

then you may be entitled to a remedy. Depending on the nature and severity of the problem, that remedy may be a re-supply of the service, a partial refund, or a full refund.

We do not say "no refunds" — that is not consistent with Australian law. If you believe you have a consumer guarantee issue, please contact us at brainfrequency@tihna.com.au and we will address it promptly.

Refunds for change of mind

Outside of your ACL rights, refunds are at our discretion and are generally not provided for:

  • Change of mind after purchase
  • Forgetting to cancel before a renewal charge
  • Not using the app during a paid subscription period

If you were charged for an auto-renewal and immediately contact us (within 48 hours of the charge), we will consider your request in good faith.

Apple's refund process

Because payments are processed through Apple, some refund requests may need to be made directly to Apple via reportaproblem.apple.com. Apple has its own refund policies that operate independently of these Terms.

10. Intellectual property

All content in the Tihna app — including audio tracks, sound frequencies, soundscapes, artwork, design, text, software code, trademarks, and logos — is owned by or licensed to Tihna Health. It is protected by Australian and international intellectual property laws.

Your subscription or use of the app gives you a personal, non-exclusive, non-transferable, revocable licence to access and use the Tihna content for your own personal, non-commercial purposes. This licence does not give you ownership of any content.

You must not:

  • Copy, record, reproduce, or redistribute any audio content from Tihna
  • Modify, adapt, or create derivative works from Tihna's content
  • Remove or alter any copyright or trademark notices
  • Use any Tihna content in a commercial product or service
  • Reverse-engineer or attempt to extract source code from the app

If you believe any content in Tihna infringes your intellectual property rights, please contact us at brainfrequency@tihna.com.au.

11. Your responsibilities and prohibited conduct

When using Tihna, you are responsible for ensuring that your use complies with these Terms and with all applicable laws.

You must not use Tihna to:

  • Violate any law or regulation
  • Infringe any third party's intellectual property, privacy, or other rights
  • Transmit any material that is harmful, offensive, threatening, defamatory, or fraudulent
  • Attempt to gain unauthorised access to any part of the app, our servers, or systems connected to the app
  • Interfere with or disrupt the app or its infrastructure
  • Use automated tools, bots, or scripts to access or interact with the app
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Use the app for any commercial purpose without our written consent
  • Circumvent, disable, or interfere with any security features or access controls

We reserve the right to suspend or terminate your account if you breach these Terms. We will generally give you notice and an opportunity to remedy a breach unless the breach is serious, ongoing, or puts other users or Tihna at risk.

12. Limitation of liability

What we are responsible for

We take care in building and maintaining Tihna, but we cannot guarantee that the app will be available 100% of the time, free from errors, or that results from using the app will meet your specific expectations.

To the maximum extent permitted by law:

  • We are not liable for any loss or damage that was not reasonably foreseeable as a result of using Tihna.
  • We are not liable for indirect, consequential, incidental, special, or punitive losses (such as lost profits or loss of opportunity) arising from your use of the app.
  • Our total liability to you for any claim arising from your use of Tihna is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

What this section does not limit

Nothing in these Terms limits or excludes any rights you have under the Australian Consumer Law that cannot be excluded by law, including your consumer guarantee rights. If the ACL applies to your situation, we will honour those rights regardless of any other provision in these Terms.

Wellness and health disclaimer

We do not accept liability for any health outcomes — positive or negative — that you attribute to using Tihna. As stated in Section 3, Tihna is a general wellness tool and is not intended to provide health, medical, or therapeutic outcomes. Any wellness benefits you experience are a result of your own use of the app in conjunction with your own healthy lifestyle choices.

13. Changes to the app and these Terms

Changes to the app

We are always working to improve Tihna. We may update, modify, or remove features from the app from time to time. We will try to give you reasonable notice of significant changes, particularly if they affect paid features.

If we need to substantially reduce or discontinue the Tihna service for Lifetime subscribers, we will provide as much notice as possible and, where appropriate, offer a fair remedy.

Changes to these Terms

We may update these Terms from time to time to reflect changes in the app, our business, or our legal obligations. When we make material changes, we will:

  • Notify you by email (to the address associated with your account) or through a notification in the app; and
  • Post the updated Terms at tihna.com.au, with the effective date clearly stated.

If you continue to use Tihna after the effective date of the updated Terms, you agree to the updated Terms. If you do not agree to the changes, you may cancel your subscription and stop using the app.

We will not apply material changes to these Terms retrospectively in a way that disadvantages you without giving you an opportunity to cancel first.

14. Deleting your account

You have the right to delete your Tihna account at any time.

To delete your account within the app:

Go to Settings → Account → Delete Account within the Tihna app and follow the prompts.

Alternatively, you can email us at brainfrequency@tihna.com.au and request account deletion. We will process your request within a reasonable time.

When you delete your account:

  • Your account and associated personal data will be deleted or anonymised in accordance with our Privacy Policy.
  • Any active subscription is not automatically cancelled by deleting your account — you should also cancel your subscription through Apple (see Section 8) to avoid future charges.
  • Deleting your account does not entitle you to a refund for any unused subscription period, except where your consumer guarantee rights under the ACL apply.

15. Governing law and dispute resolution

These Terms are governed by the laws of Victoria, Australia. You and Tihna Health both agree to submit to the non-exclusive jurisdiction of the courts of Victoria for any disputes.

Resolving disputes

We prefer to resolve any disputes directly and informally. If you have a concern or complaint:

  1. Contact us first — email brainfrequency@tihna.com.au with a description of your concern. We will respond within 10 business days and work with you to find a fair resolution.
  1. If we can't resolve it directly — if we are unable to resolve the dispute within 30 days of your initial contact, either party may refer the matter to:

- Consumer Affairs Victoria (consumer.vic.gov.au) for consumer disputes; or

- The Australian Competition and Consumer Commission (ACCC) (accc.gov.au); or

- Mediation or another agreed alternative dispute resolution process.

  1. Legal proceedings — if informal resolution and alternative dispute resolution are unsuccessful, either party may pursue their rights through the courts of Victoria.

Nothing in this section prevents you from exercising any statutory rights you have as a consumer, including the right to contact a regulator.

General provisions

Entire agreement

These Terms, together with our Privacy Policy (available at tihna.com.au), form the entire agreement between you and Tihna Health regarding your use of the app.

Severability

If any part of these Terms is found to be invalid or unenforceable under applicable law, that part will be severed and the rest of the Terms will continue in full force.

Waiver

If we do not enforce a provision of these Terms on one occasion, that does not mean we have waived our right to enforce it in the future.

Assignment

You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights or obligations — for example, if we sell or merge our business — and we will notify you if this affects your rights.

Apple

These Terms are between you and Tihna Health, not between you and Apple. Apple is not responsible for Tihna or its content. Apple has no obligation to provide maintenance or support for Tihna. To the extent Apple provides any default end user licence terms, these Terms take precedence to the extent permitted by Apple's guidelines.
